Enforcement & Remedies

Risk-tiered enforcement, appeals, and legal remedy framework.

v2026-10-v8Effective 2026-10-18

This framework governs how XUSLABS LTD (trading as AIFACECRAFT) enforces policy violations, protects platform integrity, and applies legal remedies. It is incorporated into and supplements our Terms of Service and Acceptable Use Policy. In the event of conflict, the Terms of Service prevail.

1. Scope and Application

This framework applies to all users, accounts, content, and activity on or through the Service. It applies regardless of whether the user acts personally, through automation, through agents, or through third parties operating on their behalf.

2. Proportionality Principle

Enforcement actions are proportionate to the nature, severity, impact, intent, duration, and history of the violation. Factors we may consider include (without limitation):

  • Whether the violation involves vulnerable persons, children, or high-risk categories
  • Whether the user has prior violations, warnings, or a pattern of policy circumvention
  • Whether the violation creates immediate safety, legal, or reputational risk
  • Whether the user demonstrates good-faith corrective intent
  • Applicable legal obligations including mandatory reporting duties

We are not required to apply identical outcomes to similar violations. Contextual judgment, evolving risk landscape, and operational needs may result in different enforcement responses to superficially similar situations.

3. Enforcement Outcomes

Available enforcement actions include, but are not limited to:

  • Educational notices, warnings, and corrective guidance
  • Content removal, generation blocking, and output restrictions
  • Feature-level restrictions, rate limiting, and capability reduction
  • Temporary suspension of account access (defined or indefinite duration)
  • Permanent account termination and denial of future access
  • Related-account and linked-account restrictions where evasion is detected
  • Billing controls, credit freezes, payout holds, and refund denial where permitted
  • Evidence preservation, legal hold, and referral to law enforcement or regulatory authorities
  • Civil legal action including claims for damages, injunctive relief, and cost recovery

Multiple enforcement outcomes may be applied concurrently. We may escalate enforcement at any time if new information emerges or if the user fails to comply with corrective requirements.

4. Investigation Integrity and Confidentiality

  • We may investigate suspected violations using manual review, automated detection, third-party reports, and any other lawful source of information.
  • We are not required to disclose investigation methodology, detection logic, internal scoring, threshold parameters, evidence sources, or the identity of reporters.
  • Investigation records and enforcement decisions constitute our confidential business information.
  • We may preserve and retain enforcement-related records beyond standard retention periods for legal defense, regulatory compliance, and pattern detection.

5. Preemptive and Emergency Action

We may act preemptively, without prior notice or opportunity to respond, where delay could increase harm, legal exposure, or risk to the platform, other users, or third parties. This includes situations involving:

  • Child safety, exploitation, or mandatory reporting obligations
  • Imminent harm, threats, or credible safety concerns
  • Active fraud, payment abuse, or financial crime indicators
  • Platform security incidents, coordinated attacks, or system abuse
  • Court orders, legal process, or regulatory directions requiring immediate action

6. Repeat Violation and Evasion Policy

Users who repeatedly violate policies, evade enforcement through new accounts, circumvent restrictions through technical means, or demonstrate a pattern of bad-faith engagement may be subject to immediate permanent denial of access across all current and future accounts without further notice.

We may use technical signals, device fingerprinting, payment instrument linking, and other lawful methods to identify evasion attempts.

7. Appeals Process

  • Users may appeal enforcement decisions by contacting support@aifacecraft.com with specific facts, dates, and evidence supporting the appeal.
  • Appeals must be submitted within thirty (30) days of the enforcement action.
  • We will review appeals in good faith but are not obligated to reinstate content, accounts, or credits where legal, safety, or policy concerns remain.
  • Appeal decisions are final unless material new evidence is presented that was not previously available.
  • Repeated, abusive, harassing, or bad-faith appeals may be closed without further review.

8. Cooperation with Authorities

We cooperate with lawful requests from courts, law enforcement, regulatory bodies, and competent authorities. This includes:

  • Responding to valid legal process (court orders, subpoenas, regulatory notices)
  • Preserving data and evidence when required by law or reasonably anticipated legal proceedings
  • Making mandatory referrals for child safety, terrorism, and other legally required categories
  • Providing technical assistance where required by applicable law

We may notify affected users of legal process to the extent permitted by law, unless prohibited by court order, legal obligation, or where notification would compromise an investigation.

9. Our Remedies

In addition to enforcement actions described above, we reserve all rights and remedies available at law and in equity, including but not limited to:

  • Claims for damages (including consequential and indirect losses where recoverable)
  • Injunctive and equitable relief without requirement to post bond where permitted
  • Recovery of investigation costs, legal fees, and enforcement expenses
  • Account value recovery, credit clawback, and offset against outstanding balances
  • Referral to debt collection where applicable

Remedies are cumulative and not exclusive. Exercise of one remedy does not waive or preclude any other.

10. User Remedies and Limitations

Your exclusive remedies for disputes arising from enforcement actions are: (a) the appeals process described above; and (b) proceedings in the courts specified in our Terms of Service governing law clause, subject to the claim window and procedural requirements therein. No other remedies, processes, or forums are implied or available except as mandated by non-excludable statutory rights.

11. No Waiver

Delay, omission, or failure to enforce any right, remedy, or provision does not constitute a waiver of that or any other right. A waiver is effective only if given in writing by an authorized representative.
