Copyright (DMCA)
Notice and counter-notice process for rights holders.
XUSLABS LTD (trading as AIFACECRAFT) respects intellectual property rights and complies with applicable copyright laws, including the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent provisions under the laws of England and Wales and the EU.
DMCA Safe Harbor
We operate as a service provider within the meaning of 17 U.S.C. § 512. We do not monitor all user-generated or AI-generated content proactively for copyright infringement. Upon receipt of a valid notice that complies with the requirements below, we will expeditiously remove or disable access to allegedly infringing material in accordance with applicable law.
Designated Agent for Copyright Notices
Name: Copyright Agent, XUSLABS LTD
Email: legal@aifacecraft.com
Address: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom
This designated agent is authorized to receive notifications of claimed infringement under applicable copyright laws.
How to Submit a Notice of Infringement
To submit a valid copyright notice, provide the following information in writing to the Designated Agent:
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved).
- Identification of the material you claim is infringing, with information reasonably sufficient for us to locate it (e.g. URL or content identifier).
- Your contact information (name, address, telephone number, and email address).
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury (for U.S. notices), that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Your physical or electronic signature (or that of the person authorized to act on behalf of the owner).
Incomplete or non-compliant notices may be returned without action. We may request additional information before processing a notice.
Counter-Notice Process
If you believe your content was removed or disabled in error or due to misidentification, you may submit a counter-notice to the Designated Agent including:
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury (for U.S. counter-notices) that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your district (or, for non-U.S. residents, the courts of England and Wales) and that you will accept service of process from the complainant.
- Your physical or electronic signature.
Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the material after the statutory waiting period (typically 10–14 business days for DMCA) unless the complainant files a court action.
Repeat Infringer Policy
We maintain a policy for the termination, in appropriate circumstances, of users who are repeat infringers of copyright. Factors we consider include:
- The number of valid infringement notices received against the account
- Whether the user has filed valid counter-notices or demonstrated good-faith compliance
- The nature and severity of the alleged infringement
- Whether the user has previously been warned or had content removed
We do not commit to a specific strike count. Termination decisions are made on a case-by-case basis considering the totality of circumstances. A single egregious infringement may warrant immediate termination.
Misrepresentation and Abuse of Process
Submitting a knowingly false, materially misleading, or bad-faith notice or counter-notice may expose you to liability for damages (including costs and attorney fees) under 17 U.S.C. § 512(f) and equivalent provisions under applicable law.
We reserve the right to reject abusive, harassing, or clearly invalid submissions and to preserve records of such submissions for potential legal action.
No Adjudication of Ownership
We are not a court and do not adjudicate ownership disputes, fair use claims, or the validity of copyright registrations. Our takedown and restoration actions are compliance measures and do not constitute a legal determination of title, infringement, fair use, or any other legal question.
